Prohibition is Not Protection: Betano’s Statement on Provisional Measure 1,394/2026

October 1, 2026 news

Since the publication of Provisional Measure 1,394/2026 on September 25, Betano has fully complied with the measures established, as it always does in every market where it operates.

We believe, however, that this measure represents an abrupt change in the path of building and evolving Brazil’s regulated online betting market and puts at risk important progress made in recent years, particularly in consumer protection, combating the illegal market, generating tax revenues for the country, and providing the legal certainty required for long-term investment.

Prohibition is not protection. Rules, oversight and education are.

Over the past two years, Brazil has made important strides, introducing self-exclusion, betting limits and restrictions protecting Bolsa Família beneficiaries thanks to regulation. By building on the lessons learned during this period and maintaining an open dialogue, the country can build on this progress and further strengthen its tools.

Prohibition does not eliminate demand. It risks redirecting consumers towards illegal operators that do not comply with Brazilian regulation, do not provide the same consumer protections and do not contribute to the BRL 10 billion in annual tax revenues generated by the regulated sector.

The consequences for the economy extend far beyond betting companies. They affect a complex ecosystem involving small and medium-sized businesses across technology, telecommunications, media, services and education, as well as the wider sports economy. Tax revenues generated by the regulated sector have also supported areas of Brazilian society including healthcare, tourism and public security.

Betano believes in the rule of law, Brazil’s institutions and dialogue.

We hope that, as the Provisional Measure is reviewed, its impacts will be broadly and responsibly considered and that a solution can be found that preserves the progress achieved through regulation, strengthens consumer protection and effectively combats the illegal market.

At this time, our priority is to retain our employees and seek to fully honor the commitments already made as part of our social investments.

Other initiatives that depend on the continuation of regulated operations will unfortunately need to be suspended in compliance with the new legal framework, until there is greater clarity regarding the regulatory landscape.

We thank our customers, employees, suppliers, partners, and everyone who has contributed to building this industry to date.

We remain committed to Brazil and to building a responsible, regulated, and safe market.
